In this article we explore the two emotional experiences of hypervigilance and attention. These emotions are associated with both military training and with posttraumatic stress among other disorders. We consider the way that these emotions can be experienced after exposure to combat as well as grievous bodily injury, and seek to untangle situations in which they are artifacts of military training and identity rather than symptoms. The data for this article are drawn from interviews and observations with former patients of (...) the US Armed Forces Amputee Patient Care Program at the Walter Reed National Military Medical Center. An experience like hypervigilance is often treated as a symptom of posttraumatic stress disorder (PTSD) or mild traumatic brain injury. Some experts place the number of returning service members with either or both of these disorders in the hundreds of thousands. While some participants in our study have received diagnoses of either PTSD or mild traumatic brain injury, in many cases they experience emotions like hypervigilance, differently. Rather than being troubled by hypervigilance, they experience it as a valued legacy of their military training and an important characteristic that distinguishes them from civilians. (shrink)

In this article we present a conjecture regarding the biology of subjectivity and feeling, based on biophysical and phenomenological considerations. We propose that feeling, as a subjective phenomenon, would come to life as a process of resistance to variance hypothesized to occur during the unfolding of cognition and behaviours in the wakeful and emoting individual. After showing how the notion of affect, when considered from a biological standpoint, suggests an underlying process of resistance to variance, we discuss how vigilance, emotional (...) arousal and attentional behaviours reflect a dynamics of controlled over-excitation related to cognitive integration and control. This can be described as a form of resistance to variance. We discuss how such a dynamics objectively creates an internal state of tension and affectedness in the system that could be associated with subjective states. Such a dynamics is shaped by the system's need to cope with its own inertia, to engage in intentional behaviours, attend, preserve coherence, grapple with divergent cognitive, emotional and motivational tendencies, and delayed auto-perturbations of the brain-body system. More generally, it is related to the need to respect the hierarchy of the various influences which affect its internal dynamics and organization. (shrink)

The Signature of All Things is Giorgio Agamben's sustained reflection on method. To reflect on method implies for Agamben an archaeological vigilance: a persistent form of thinking in order to expose, examine, and elaborate what is obscure, unanalyzed, even unsaid, in an author's thought. To be archaeologically vigilant, then, is to return to, even invent, a method attuned to a "world supported by a thick weave of resemblances and sympathies, analogies and correspondences." Collecting a wide range of authors and topics (...) in a slim but richly argued volume, Agamben enacts the search to create a science of signatures that exceeds the attempts of semiology and hermeneutics to determine the pure and unmarked signs that signify univocally, neutrally, and eternally. Three conceptual figures organize Agamben's argument and the advent of his new method: the paradigm, the signature, and archaeology. Each chapter is devoted to an investigation of one of these concepts and Agamben carefully constructs its genealogy transhistorically and from an interdisciplinary perspective. And at each moment of the text, Agamben pays tribute to Michel Foucault, whose methods he rethinks and effectively uses to reformulate the logic of the concepts he isolates. The Signature of All Things reveals once again why Agamben is one of the most innovative thinkers writing today. (shrink)

According to philosophical situationists, empirical psychology suggests that most people are not virtuous, and that we should be skeptical about the possibility of cultivating virtue. I argue against the second claim by offering an empirically informed model of character formation. The model begins with ancient formational wisdom emphasizing emotion education, the practice of spiritual exercises, self-monitoring, and willpower, and is confirmed, nuanced, and supplemented by insights from recent empirical psychology. Many ancient philosophers, recent social psychologists, and philosophers of emotion agree (...) that emotions are central to moral cognition. I defend a perceptual account of emotion, and show how this account suggests a practical upshot that empirical psychologists tend not to emphasize, but that the ancients would endorse: emotion education should be a primary focus of character formation. I dilate on this practical point using the remediation of inappropriate anger as a test case. Taking my remedial cues from the Stoic and Christian traditions, I argue that training the emotions through self-monitoring, willpower, and the use of “spiritual exercises”—practices of mind and body whereby one digests the doctrines of one’s philosophical school, so that those doctrines are not matters of mere notional understanding, but actually take up residence in one’s vision of the world—provides hope for meaningful movement in the direction of virtue. The rigorous practice of spiritual exercises involves difficult work. To have much success, the moral trainee will need at least the seeds of what I call “remedial virtues”: character excellences that enable an agent to do the demanding work of re-cultivating her character. The remedial virtues include self-vigilance and the virtues of willpower. I develop empirically informed philosophical analyses of self-vigilance and the virtues of willpower, and offer empirical evidence to support the claim that they can be cultivated. Then I show how the remedial virtues can help us resist temptation, leverage temptation in the interest of further growth in character, and correct for the subtle situational forms of moral interference that situationists emphasize. According to this theory, given a behavioral space in which the agent has multiple inputs and outputs to choose from, attention involves (...) the selection of a particular course of action, that is, of certain outputs based on certain inputs. In the present work Wu puts to use the selection-for-action theory to shed light on the broader topic of the “movements of the mind”: intentionality and action. Action and movement are mostly not intended as bodily movement: By focusing on mental actions Wu aims to simplify philosophical explanations. His overall theoretical approach remains consistent with his work on attention, which involves a quest to develop rigorous philosophical concepts while incorporating insights from the empirical sciences. Interestingly, biology takes precedence over cognitive sciences and psychology for him; he says, “I aspire to a biology of agency” in which philosophical analysis must respond to “empirical friction.” In this framework, this book puts forth four main claims. The first concerns the general structure of action—action arises from solving a selection problem. Second, intentional actions can be differentiated from unintentional actions using the concepts of automaticity and control. Third, Wu argues that attention is a necessary aspect of every theory of action. Fourth, he claims that intention is practical memory for action. These four are woven throughout the different chapters of his book.The first part analyzes the structure of action along three axes: how the agent “takes things to be” as the basis for selection, the agent’s response to those things, and the biases that explain the link between perceptions and responses. In the second part, Wu presents a theory of intention as practical memory. The theory is surprising, as Wu himself acknowledges when he says, “The approach to intention will, I think, jar many readers.” And indeed, it does, but Wu provides strong arguments, and future work will determine if the theory is feasible. Between 1234 and 1258 King Henry III, having emerged from the tutelage of ministers inherited from his father, controlled the government of England himself. Looking at this period of personal rule, it would be easy to gain the impression that Henry's kingship, in its theory, and also to some extent its practice, challenged the position of the magnates. M. T. Clanchy, for example, in a justly famous article has suggested that in the 1240s and 1250s Henry III evolved a theory (...) of royal absolutism, a theory which had threatening implications for the magnates. He has also stressed the extent to which Henry was “the initiator both of the methods and of the theory” behind Edward I's quo warranto campaign, which questioned the liberties possessed by the magnates in the field of local government. As for Henry's court, the impression has been given by R. F. Treharne that few English barons were present there, and that the king was largely surrounded by officials and foreign relatives — the latter being his wife's Savoyard uncles and his own Poitevin half-brothers of the house of Lusignan. G. W. S. Barrow has written that Henry “appeared to be excluding the barons as a class from membership of his royal council.” The question whether Henry, like his father John, was pressing magnates to pay their debts has never been investigated; but Matthew Paris's picture of the king as a “vigilant and indefatigable searcher after money” might indicate that the revolution of 1258, like that of 1215, was a “rebellion of the king's debtors.”. Social fears emerging in adolescence can have negative effects on emotional well-being. Yet the mechanisms by which these risks occur are unknown. One possibility is that associative learning results in fears to previously neutral social stimuli. Such conditioned responses may alter subsequent processing of social stimuli. We used a novel conditioning task to examine how associative processes influence social fear and attention orienting in adolescents. Neutral photographs were paired with socially rewarding or aversive stimuli during conditioning; a dot-probe task then (...) assessed biases in attention orienting. The social conditioning task modified subjective ratings of the neutral stimuli. Moreover, for the neutral stimulus that was paired with the aversive stimulus, the strength of conditioning showed a relationship with subsequent attentional vigilance. The findings elucidate mechanisms by which negative peer experiences during adolescence may affect emotional processing. (shrink)

This article presents two studies that deepen the theme of how soundtracks shape our interpretation of audiovisuals. Embracing a multivariate perspective, Study 1 ( N = 118) demonstrated, through an online between-subjects experiment, that two different music scores (melancholic vs. anxious) deeply affected the interpretations of an unknown movie scene in terms of empathy felt toward the main character, impressions of his personality, plot anticipations, and perception of the environment of the scene. With the melancholic music, participants felt empathy toward (...) the character, viewing him as more agreeable and introverted, more oriented to memories than to decisions, while perceiving the environment as cozier. An almost opposite pattern emerged with the anxious music. In Study 2 ( N = 92), we replicated the experiment in our lab but with the addition of eye-tracking and pupillometric measurements. Results of Study 1 were largely replicated; moreover, we proved that the anxious score, by increasing the participants’ vigilance and state of alert (wider pupil dilation), favored greater attention to minor details, as in the case of another character who was very hard to be noticed (more time spent on his figure). Results highlight the pervasive nature of the influence of music within the process of interpretation of visual scenes. (shrink)

Negation has occupied a unique place in the history of ideas. Negation as opposed to truth-conditional affirmation has been very much present in Indian and Western thought from very early times. R. S. Bhatnagar of happy memory (1933–2019) in his “Many Splendoured Negation” (Bhatnagar in J Indian Counc Philos Res XXII(3):83–906, 2006) had shown many a facet that could be construed in “negation”. This paper is an attempt to revisit the notion of negation that R. S. Bhatnagar brought to light (...) and to further the germane thought that he had outlined in his concise exposé. Though Bhatnagar had stated that there could be negative and positive functions of negations, a vigilant reading of his article shows that the primary import of Bhatnagar is to examine the positive function of negation. According to R. S. Bhatnagar, even death, which could be the negative in its most feared form, the reality of which, has the positive effect on the soul force in its commitment to live well and die well. R. S. Bhatnagar’s engagement with negation is not complete unless one takes into consideration “negation” as an integral part of philosophizing in India, whether it is the Buddhist tradition or any other tradition. One encounters the philosophical “exercise” on negation enormously in Buddhist thought. The first part of the paper is a brief discussion on the views of Bhatnagar in his essay mentioned with the author’s considerable add-on, while the second part brings home the Buddhist facet and paradigm of negation, the missing link in Bhatnagar. HeartMath is a contemporary, scientific, coherent model of heart intelligence. The aim of this paper is to review this coherence model with special reference to its implications for artificial intelligence and robotics. Various conceptual issues, implications and challenges for AI and robotics are discussed. In view of seemingly infinite human capacity for creative, destructive and incoherent behaviour, it is highly recommended that designers and operators be persons of heart intelligence, optimal moral integrity, vision and mission. This implies that AI and (...) robotic design and production should be continuously optimized through vigilant and appropriate human and material quality control procedures. As boundaries between domesticity and the undomesticated increasingly blur for cohabitants of Vancouver Island, home to North America’s densest cougar population, predatorial problems become more and more pressing. Rosemary-Claire Collard responds on a pragmatic plane, arguing that the encounter between human and cougar is only ever destructive, that contact results in death and almost always for the cougar. Advocating for vigilance in policing boundaries separating cougar from civilization, therefore, she looks to Foucault’s analysis of modern biopower in the first volume (...) of his History of Sexuality for support in favor of a more contemporary notion of biosecurity. In response to Collard’s arguments, concerned with ethical conclusions drawn on the basis of her policy-based proposal, I challenge the prohibition she places on encounter. In the first section, “Becoming Killable,” I address her use of Donna Haraway’s phraseology, and in the second section, “Biological Dangers,” I scrutinize her reading of Foucault, arguing that the appeals she makes distort the mode of argumentation at work for each thinker. The final section, “Facing Cougar, Facing Death,” advocates further ethical possibilities generated on the basis of Foucault’s correlation between overcoming the fear of death and resisting abuses of power with respect to others. My contention is that our transgressing boundaries constructed to separate humanity from the inhumane curtails tendencies toward the marginalization and subjugation of those animal others whose very existence brings us face to face with the fact of our own mortality. We present evidence that smiling is positively associated with positive affect in women and negatively associated with negative affect in men. In line with Vigil's model, we propose that, in women, smiling signals warmth (trustworthiness cues), which attracts fewer and more intimate relationships, whereas in men, smiling signals confidence and lack of self-doubt (capacity cues), which attracts numerous, less-intimate relationships.

There is an intriguing recent effort to develop a valid cosmological argument on the basis of quite minimal assumptions.1 Indeed, the basis of the new cosmological argument is so slight that it is likely to make even a conscientious theist suspicious – to say nothing of our vigilant atheists. In Section 1 we present the background assumptions and central premises of the new cosmological argument. We are sympathetic to the conclusion that there necessarily exists an intelligent and powerful creator of (...) the actual universe, but we show in Section 2 that the new cosmological argument cannot establish this claim. Specifically, we show by reductio ad absurdum that the new argument is unsound, and that every plausibly modified version of the argument is also unsound.2 We close our discussion with a diagnosis of what went wrong in the new cosmological argument. Our conclusion is that this intriguing new argument promises considerably more than it can show. (shrink)

Purpose The purpose of this paper is to demonstrate the advancements in artificial intelligence (AI) and conversational agents, emphasizing their potential benefits while also highlighting the need for vigilant monitoring to prevent unethical applications. Design/methodology/approach As AI becomes more prevalent in academia and research, it is crucial to explore ways to ensure ethical usage of the technology and to identify potentially unethical usage. This manuscript uses a popular AI chatbot to write the introduction and parts of the body of a (...) manuscript discussing conversational agents, the ethical usage of chatbots and ethical concerns for academic researchers. Findings The authors reveal which sections were written entirely by the AI using a conversational agent. This serves as a cautionary tale highlighting the importance of ethical considerations for researchers and students when using AI and how educators must be prepared for the increasing prevalence of AI in the academy and industry. Measures to mitigate potential unethical use of this evolving technology are also discussed in the manuscript. Originality/value As conversational agents and chatbots increase in society, it is crucial to understand how they will impact the community and how we can live with technology instead of fighting against it. Music plagiarism is defined as using tune, or melody that would closely imitate with another author’s music without proper attributions. It may occur either by stealing a musical idea or sampling. Unlike the traditional music, the Indian cinematic music is extremely popular amongst the public. Since the expectations of the public for songs that are enjoyable are high, many music directors are seeking elsewhere to “borrow” tunes. Whilst a vast majority of Indian cinemagoers may not have noticed these plagiarised tunes, (...) some journalists and vigilant music lovers have noticed these activities. This study has taken the initiative to investigate the extent of plagiaristic activities within one Indian cinematic music industry. A list of plagiarised songs was produced by using YouTube® searches for “comparative videos” made by the vigilant music lovers about accused/detected music plagiarism. Some of these individuals were also interviewed to understand their views on this. During the investigation, it was possible to identify a vast number of plagiarised tunes, snippets, or even the full songs. In fact, some of these examples’ dates to 1954, during the era when no one would have noticed plagiarism. The paper would highlight the similarities of these music files. It will also show some examples of the excuses/denial given by the composers and would try to highlight the attitudes of general public towards these types of activities. (shrink)

Porter son attention sur l'attention, voilà l'urgence de notre humanisation contemporaine. Les sciences l'ont compris, qui depuis plus d'un siècle multiplient les travaux en psychologie et en neurosciences sur cette fonction complexe et globale qui forme un réseau intégré transversal où jouent mémoire, perception, veille, émotion et décision ; les techniques méditatives ont aussi leur rôle à jouer, s'adressant moins à notre intellect, comme les sciences, qu'à l'attitude fondamentale face à la vie. Elles nous proposent une clé en matière de (...) pratique de la présence à soi. Devant l'impact croissant des sciences et la visibilité actuelle des techniques méditatives, quel rôle jouera la phénoménologie? Contrairement aux autres approches philosophiques, elle possède ce plus de tenir en un regard ouvert sur le monde : par son retour à l'expérience, elle fait alliance avec la visée expérimentale des sciences et, par sa méthode de suspension, elle entre en contact avec une quête contemplative qui est prise de recul. Elle joue ainsi un rôle-charnière pour repenser l'attention en en faisant une expérience d'ouverture au monde davantage qu'un état mental interne. La phénoménologie apporte quelque chose d'inédit : une éthique de l'attention, qui réforme celle-ci en " vigilance ". (shrink)

La fréquentation de l'œuvre de Stefan George et l'influence qu'exerça très tôt sur lui le cercle de ses adeptes ont à cet égard valeur de commencement, donc une signification insigne, s'il est vrai, comme le suggère Aristote après Hésiode, que «le commencement est plus que la moitié du tout»... Plutôt que les abstractions et les constructions de la philosophie, c'est-à-dire, à l'époque, de l'épistémologie néo-kantienne, c'est donc l'horizon littéraire des Dostoïevski, Kierkegaard et Tagore, sans compter la lecture des classiques grecs, Homère et Pindare en tête, qui nourrit les pensées du jeune étudiant de MarbourgMais c'est évidemment la rencontre avec Heidegger, à l'été 1923, qui devait donner à Gadamer son véritable élan philosophique. Le projet d'une herméneutique de la facticité que poursuivait Heidegger, dans ses premières leçons de Fribourg, lui apprit surtout qu'il n'est de véritable savoir que celui qui procède de la concrétude du Dasein et du souci de son existence. Comme un lointain écho à l'éthique d'Aristote, la philosophie redécouvrait enfin à travers Heidegger son intimité avec la mobilité de la vie, la distanciation et le contrôle épistémologiques faisant place à un savoir de situation qui ressortit moins à l'ego pur qu'à l'assise temporelle et à la modalité compréhensive de l' être-au-monde. La justice prédictive qui consiste à évaluer les probabilités de succès des procès par un traitement informatique est une innovation technologique importante. Elle pourrait avoir des effets sur les principes fondamentaux des procès, notamment du procès civil. Le droit au juge et le principe de l’égalité des armes qui protègent les droits des parties risquent d’être affectés. Les principes d’indépendance et d’impartialité du juge pourraient également être perturbés ainsi que l’office du juge. Sommes-nous au seuil d'une éclipse de l'humanisme? Le choc des civilisations, la mondialisation anarchique, le capitalisme débridé, le fondamentalisme religieux, le dérèglement étique et la perte de confiance en soi vont-ils faire reculer la civilisation de plusieurs siècles? Un peu à l'instar de l'Occident au tournant des Ve et VIe siècles après que de vastes mouvements de populations eurent raison de l'empire romain? Ou encore, à l'image des peurs délirantes qui hantèrent l'Europe entre les XIVe et XVIIe siècles des suites (...) de la grande peste? Bien malin qui pourrait prévoir l'avenir. Le propos de ce livre est d'appeler le lecteur à la lucidité et à la vigilance. Au cours de son histoire récente, notre humanité s'est retrouvée plus d'une fois au bord de l'abîme. Le fait que nous y ayons globalement échappé doit nous inviter à la confiance en la capacité humaine à ne pas s'autodétruire. Cependant, pareille sérénité ne peut faire perdre de vue qu'il n'existe aucune assurance tous risques contre la folie suicidaire qui, par moment, se saisit des civilisations. Early Syriac Christianity presents two notable paradigms for understanding liturgy as a means for the ethical formation of the congregation. Ephrem the Syrian (d. 373) in his hymns for the Nativity vigil, and Jacob of Sarug (d. 521) in his verse homilies, each addressed their congregations in ways that utilized ritual participation in the liturgy for ethical and moral cultivation. Ephrem sought to instill his congregation with a biblical and theological understanding of the Nativity that would yield ethical enactment (...) in the world. Jacob worked to use the experience of liturgical participation to mold the Christian’s moral disposition. For both, God’s salvation enabled the healing of the human condition in its various dimensions: physical, social, ecclesial. Liturgy as disciplined ritual activity provided the tools by which their congregations could learn, experience, and enact that healing. (shrink)

Le cadre de la thérapie familiale permet la restauration d’une sécurité de base autorisant la régression, dont la présence réelle des enfants est un puissant activateur. L’auteur, thérapeute familiale psychanalytique, illustre différentes problématiques de couple, à travers des vignettes cliniques, en pointant les limites du travail possible dans ce (...) dispositif : vigilance dans les interventions qui doivent rester groupales-familiales et protection des enfants contre des débordements à caractère exhibitionniste, sexuel ou pervers. À ces conditions, le couple parental, suffisamment dégagé des scories d’un transgénérationnel encombrant, peut éventuellement s’engager en parallèle ou ultérieurement dans un authentique travail de couple. This Ph.D. thesis is, in large part, a deepening of my M. A. dissertation, entitled: "Différance Beyond Phenomenological Reduction (Epoché)?" - an edited version of which was published in The Warwick Journal of Philosophy, Vol. 2, Issue 2, 1989. The M. A. dissertation explores the development of the various phases of the movement of epoché in Edmund Husserl's phenomenology and its relevance for Jacques Derrida's project of deconstruction. The analyses not only attend to the need for an effective propaedeutic to (...) an understanding of phenomenology as method, they also serve to demystify the logics of Derridean non-teleological strategy by explaining the sense of such a manoeuvre - as a kind of maieutic response to the Husserlian project - which operates within the horizon of a radical epoché. According to this orientation, Derrida's deconstruction of phenomenology is permitted to open itself up to a phenomenology of deconstruction. This doctoral thesis develops these analyses and utilizes a form of critique that points the way to the possibility of a phenomenological-deconstruction of the limits of Derrida's project of deconstruction through the themes of epoché, play, dialogue, spacing, and temporalization. In order to trace the resources from which he draws throughout the early development of deconstruction, this study confines itself to a discussion on the texts published between 1962 and 1968. This subjection of deconstruction to a historical de-sedimentation of its motivational, methodological, theoretical, and strategic moments, involves a certain kind of transformational return to the spacing between phenomenology and deconstruction that urgently puts into question the alleged supercession of phenomenology by deconstruction. The expression of such a 'beyond' is already deeply sedimented in contemporary deconstructive writing to the point at which it is now rarely even noticed, let alone thematized and brought into question. This conviction (regarding the transgression of phenomenology by deconstruction) traces itself out in the form of an attitude to reading which is, in fact and in principle, counter to D6rrida's own call for care. The meaning and limits of the very terms, transgression, beyond, supercession, etc., must be continually subjected to deconstruction. The notions of play, dissemination and supplementarity - with the concomitant sense of transformational repetition that defines them - do not function as a mere excuse for lack of scholarly rigour. Deconstruction is a movement of critical return, which must insert itself (with a sense of irony) within the margins and intersections of that which gives itself up to this practice of textual unbuilding. The strategy of play encourages the structural matrix of that with which it is engaged to turn in upon itself, exposing its limits and fissures in a kind of textual analogue to a psychoanalysis. To be sure, this does involve a certain kind of violence -a violation of the ( system's' own sense of propriety (what is proper [propre] and closest to itself) -but in no sense is this an anarchical celebration of pure destruction. We speak rather of irony, parody, satire, metaphor, double-reading and other tactical devices, which permit a reorganization of the deconstructed's (textual analysand's) self-relation and the possibility of playful speculation. Such play demands care and vigilance in regard to the appropriation of the logics of the system with which it is in a relation of negotiation. In order to play well, one must learn the game-rules. La célébration du 70e anniversaire de la mort de Freud est l'occasion d'une réflexion sur sa théorie de la guerre et de la mort. Fondée sur le mythe de la horde primitive, le meurtre du père et la dette commune, la société, selon Freud, s'organise autour des interdits de meurtre et d'inceste. La guerre fondée dans la pulsion de mort est la conséquence de la levée collective de ces interdits. Freud bâtit ainsi ce que l'on pourrait nommer une " culture (...) du meurtre ". Mais dès la Première Guerre mondiale, il avait saisi qu'un bouleversement était en train de s'opérer avec la guerre totale, industrielle et informationnelle. Tout en restant fondamentalement et radicalement enraciné dans la pensée freudienne, ce travail tente de démontrer un "au-delà " de Freud dans l'apparition d'une " culture de l'extermination " qui trouve son origine dans les grands textes fondateurs des monothéismes, puis son champ de réalisation dans l'histoire occidentale principalement. Cette " culture de l'extermination " n'a pas disparu avec les horreurs du siècle dernier. Elle est toujours bien présente partout dans le monde et prête à ressurgir en Occident comme le laissent entrevoir quelques frémissements politiques dans de nombreux pays. Michel van de Kerchove : une figure de référence de la pensée pénale Tout au long de sa carrière académique et scientifique, Michel van de KERCHOVE a apporté à la pensé pénale des contributions majeures, essentielles et parfois radicales, n’hésitant pas à en bousculer les standards quand il dénonce le pouvoir mystificateur du langage ou interroge l’effectivité des normes juridiques. À travers ses innombrables travaux, il n’a cessé de rappeler l’importance d’une approche critique et interdisciplinaire du droit. Tel est dès (...) lors l’esprit et le fi l conducteur des deux journées organisées en l’honneur de celui qui fut, notamment, une cheville ouvrière de la revue Déviance et Société. La peine est un thème sur lequel Michel van de KERCHOVE a écrit les plus belles pages, mobilisant tour à tour les ressources du droit pénal et de la sociologie juridique, de la théorie générale et de la philosophie du droit. L’ambition de cet ouvrage est d’être une référence sur cette question. C’était l’occasion pour les auteurs de se mettre au travail sous le regard vigilant de Michel van de KERCHOVE, ce qui est peut-être le plus bel hommage qui pouvait lui être rendu. Le sens, la fonction et les justifications de la peine Dans un premier temps, il s’est agi d’interroger le sens, la fonction et les justifications de la peine à travers la littérature, la philosophie et la politique. La peine et les peines sont, ensuite, examinées au regard de l’exigence des droits fondamentaux garantis aujourd’hui dans les instruments universels et régionaux de protection des droits de l’homme. Les auteurs se dirigent alors vers les scènes européenne et internationale où se situent déjà aujourd’hui, et certainement encore plus à l’avenir, le centre de gravité du droit pénal. Les évolutions de la peine et de son exécution Dans un second temps, les auteurs abordent les évolutions de la peine et de son exécution pour interroger l’inflation pénale, la victimisation et le contexte sécuritaire qui caractérisent le droit pénal contemporain. Enfin, en abordant certains contentieux et dispositifs périphériques à la peine, ils S’interrogent le sens et les contours que prend aujourd’hui, et peut-être demain, le droit pénal. (shrink)

Comment entendre le projet d'une écologie des images? Lorsque Susan Sontag l'ébauche pour la première fois à la fin de son ouvrage de 1977 sur la photographie, il résonne comme une exhortation à la vigilance face au débordement d'images qui menace d'engloutir notre capacité de voir. Plus récemment, derrière ce souci d'une économie de l'attention, une autre inquiétude a percé, concernant cette fois les retombées environnementales de la circulation et du stockage des images numériques. Cet essai tente d'explorer une troisième (...) voie : sous l'immédiateté du visible, il s'agit de laisser affleurer les temporalités dissonantes et les vitesses contrastées qui font la tension, le ton des images dans leur venue à l'apparaître. Non seulement celles qui furent faites de la main de l'homme, mais aussi toutes les autres, depuis les infinies variations mimétiques du règne animal jusqu'aux vues produites par les machines ou le divin. Le chemin parcouru conduit de l'histoire de l'ombre (elle commence avec Pline) jusqu'à ce que Bataille aurait pu appeler une iconomie à la mesure de l'univers. Il s’avère nécessaire d’élaborer une théologie fondamentale de la sacramentalité qui implique une réévaluation de notre rapport à la théologie sacramentaire scolastique et invite à la fois à en mesurer les limites et à s’alimenter de ce qu’elle a de meilleur . Parmi les points qui requièrent une vigilance particulière, l’auteur aborde les sacrements en tant qu’actions de l’Église , le lien intime entre Parole et Sacrement . Il évoque également l’anamnèse eucharistique , l’épiclèse sacramentelle et la dimension eschatologique des (...) sacrements.It would appear necessary to set out a fundamental theology of sacramentality that entails re-evaluating our relationship to scholastic sacramentary theology and incites us both to measure its limits and to take nourishment in the best it has to offer . La rapidité d'appropriation, par les utilisateurs, des évolutions technologiques des TIC, la mouvance des usages et l'internationalisation des réseaux entravent la volonté des Etats et des acteurs de faire obstacle aux atteintes aux données personnelles et sensibles des individus et des organisations. A fortiori, l'arrivée dans le monde virtuel des réseaux sociaux, la mondialisation des moteurs de recherche et des services d'infogérance constituent de nouvelles formes de risques d'atteintes aux données personnelles ou sensibles des personnes et des organisations. De ce (...) fait, les utilisateurs des TIC se trouvent confrontés soit à une régulation et une réglementation existantes mais inaptes à les protéger, soit face à un vide juridique propice à toutes les dérives. La sensibilisation des citoyens à la vigilance, le renforcement des législations nationales, la mise en place d'une gouvernance internationale sur un « socle minimal de protection des données » , tels apparaissent les trois piliers d'une éthique à construire.The speed with which users have appropriated technological developments in the ICTs, the shifting trends in their use and the globalisation of networks are all working against the will of States and other agencies to prevent the misuse of personal and sensitive data belonging to individuals and organisations. The advent of social networking in the virtual world and the globalisation of Web search engines and outsourcing services have introduced new kinds of risks to such personal or sensitive data. ICT users are therefore either confronted with existing rules and regulations that do not offer adequate protection, or with a legal vacuum that encourages abuses of every kind. Strengthening citizens awareness, reinforcing national laws and international governance based on a core system of data protection , should be the foundations of the data use ethic we need to build up. Mais là où Weil dégage le sens formel d'une universalisation raisonnable soucieuse de prendre en charge la totalité concrète du réel, Levinas en appelle, lui, à l'intrigue dissymétrique d'une responsabilité pour l'autre, relation éthique paradoxale qui ne cesse de déchirer la trame du discours cohérent. Qu'il puisse y avoir des rapprochements entre ces (...) trajectoires contrastées n'autorise ni à les identifier ni à les «relever» à l'intérieur d'une dialectique englobante. Mais les laisser se provoquer et se répondre dans une sorte «d'entretien infini» pourrait contribuer à maintenir vive, en nous et entre nous, la vigilance jamais assez réveillée d'une liberté appelée à la responsabilité.
